TARIFF OF PORT FEES OF THE PORT ON THE ODRA OWNED BY FOSFAN SA
Port regulations

§1 General provisions

1. This tariff, established by the Management Board of FABRYKA ZIELENI SA, has been developed on the basis of the Regulation of the Minister of Infrastructure dated 08.05.02 on the level of port fees – Journal of Laws No. 74 of 14.06.02 and in which the amounts of port fees charged for the use of the Phosphate and Dolphin quays owned by FABRYKA ZIELENI are specified.

2. FABRYKA ZIELENI SA collects the following fees: wharfage and berthing and mooring fees, while the tonnage and cargo fees are collected by the Szczecin-Świnoujście Seaport Authority.

3. Services are performed on the basis of a prior written order or a concluded agreement.

4. The rates of port fees expressed in euros are converted into the currency of payment in accordance with the Table of Exchange Rates of the National Bank of Poland, according to the average rate from the date of termination of use of the port quay.

5. All fees are levied on the gross tonnage (GT) of the ship.

  • The basis for determining the amount of the port fee shall be the ship’s current international survey certificate or survey certificate, respectively, specifying the gross tonnage (GT) of the ship.
  • For vessels with a measurement certificate specifying their gross registered tonnage (GRT), it shall be assumed for the determination of the port fee that 1 GRT = 1 GT.
  • The amount of the port fee, calculated on the basis of the weight or quantity of cargo, shall be determined on the basis of the relevant shipping document.
  • For tankers with double bottom or separate ballast tanks, the basis for assessment of fees shall be the gross tonnage (GT) less the capacity of the double bottom or separate ballast tanks, as specified in the documents submitted constituting the above.

6. The ship or its representative is obliged to provide in writing all data of the ship.
7. The Tariff of Port Fees is effective as of February 1, 2006.

§2 Wharfage and berthing fees

The following amount of wharfage and berthing fees to be charged is established::

  • wharfage fee subject to para. 5.4 – 0.11 EUR / 1 GT
  • berthing fee subject to para. 5.4 – EUR 0.01 / 1 GT / 1 h for each commenced hour before and after loading before or after 4 hours
  • berthing fee without handling – EUR 0.015 / 1 GT / 1 h.

§3 Mooring fees

1. The amount of mooring fees to be charged for mooring or unmooring of a ship is established on the gross tonnage (GT):

2. Additional fees:

  • for mooring services on Saturdays (i.e., from 22:00 on the preceding day to 22:00 on Saturdays), a surcharge of 80% shall be added to the tariff rates.
  • for mooring services performed on Sundays and holidays (i.e., from 22:00 of the day before the holiday until 6:00 of the day after the holiday), an allowance of 100% shall be added to the tariff rates
